Terms of Service
Effective: April 20, 2026
By using Sway (the "Service"), you agree to these Terms of Service ("Terms"). The Service is operated by Swayn Technologies, LLC ("we," "our").
Paper trading only. Sway is a simulation. Virtual credits have no monetary value. You cannot deposit real money. You cannot withdraw real money. Market resolutions do not pay real money. If that changes in the future, these Terms will be updated and you'll be notified.
1. Acceptance
By creating an account or using the Service, you accept these Terms. If you don't agree, don't use the Service.
2. Eligibility
You must be at least 13 years old to use Sway. If you're under 18, you confirm that you have permission from a parent or legal guardian.
3. Account
You are responsible for maintaining the security of your account credentials. One account per person. You agree to provide accurate information when signing up.
4. The nature of Sway
Sway runs on virtual credits that cannot be exchanged for money, goods, or services. We grant you a limited, non-transferable, revocable license to use your credits within the Service. Credits are not property, have no monetary value, and can be adjusted or removed by us in the event of abuse.
Trade outcomes, reputation scores, and any in-app standings are educational and entertainment features. They are not a financial product or an offer to buy or sell securities.
5. Acceptable use
You agree NOT to:
- Operate automated scripts or bots against the Service without our written permission.
- Create multiple accounts to manipulate markets, rankings, or reputation.
- Abuse, harass, or target other users through calls, comments, or any other user-generated content.
- Attempt to reverse-engineer, probe, or exploit the Service beyond the normal interface.
- Submit deliberately false information intended to mislead resolution or inflate reputation.
6. User-generated content
You retain ownership of content you submit (calls, comments, profile bio). By submitting it, you grant us a worldwide, royalty-free license to display and distribute it within the Service. We may remove content that violates these Terms or applicable law.
7. Market resolutions
Each market resolves based on its published resolution criteria and primary source, recorded at market creation. In edge cases (ambiguous outcomes, source changes, data errors), admin determination is final. A market resolution log is retained for every resolved market as an audit trail.
8. Intellectual property
The Service, including its logos, copy, code, and visual design, is owned by Swayn Technologies, LLC. You may not copy, redistribute, or republish material from the Service without permission.
9. Third-party services
The Service uses Supabase (hosting + authentication), Expo (push notifications), and Google Analytics (anonymized). Your use of the Service is subject to those providers' terms where applicable.
10. Disclaimers
The Service is provided "as is" and "as available." We make no warranties about uptime, accuracy, or fitness for a particular purpose. Your use is at your own risk (though, again — no real money).
11. Limitation of liability
To the maximum extent permitted by law, Swayn Technologies, LLC is not liable for any indirect, incidental, consequential, or punitive damages, or any loss of data or opportunity, arising from your use of the Service.
12. Indemnification
You agree to defend and hold Swayn Technologies, LLC harmless against third-party claims arising from your breach of these Terms or your content.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your account for violations of these Terms or for patterns of abuse. Material suspensions will be communicated to your account email.
14. Disputes
These Terms are governed by the laws of the state in which Swayn Technologies, LLC is registered. Disputes will be resolved in the state and federal courts of that jurisdiction unless otherwise required by applicable law.
15. Changes to these Terms
We'll update these Terms from time to time. Material changes will be emailed to your account address at least 14 days before taking effect.
